Introduction
Use this checklist to help determine whether a listed or protected commercial building is likely to require a commercial EPC, or whether an exemption may apply.
This checklist is a guidance tool only. Professional advice should be sought before marketing or letting a property without an EPC.
Step 1: Confirm Building Status
✔ Is the building officially listed or formally protected?
✔ Is it located within a conservation area or subject to heritage controls?
➡ If NO, standard commercial EPC requirements apply.
➡ If YES, continue to Step 2.
Step 2: Confirm Building Use
✔ Is the building used for commercial or non-domestic purposes?
✔ Is it being sold, let or marketed?
➡ If YES, EPC obligations are likely to apply — continue to Step 3.
➡ If NO, EPC requirements may differ (seek advice).
Step 3: Assess Potential Energy Improvements
✔ Would EPC-recommended improvements be required to meet minimum standards?
✔ Would these improvements involve changes to:

Historic fabric or materials

Architectural features

Appearance or character
➡ If improvements can be made without harm, an EPC is likely required.
➡ If improvements would unacceptably alter the building, continue to Step 4.
Step 4: Check Planning & Conservation Constraints
✔ Would planning permission or listed building consent be required?
✔ Is there evidence that consent would likely be refused or restricted?
➡ If YES, an exemption may apply — evidence is required.
➡ If NO, EPC obligations may still apply.
Step 5: Consider MEES Implications
✔ Is the property intended to be let?
✔ Is the current EPC rating likely to be F or G?
➡ If YES, MEES regulations apply and compliance or exemption must be addressed.
➡ If NO, EPC may still be required for sale or marketing.
Step 6: Evidence & Registration
✔ Do you have supporting evidence (e.g. conservation advice, planning decisions)?
✔ Have you confirmed whether an exemption must be registered?
➡ Unregistered exemptions may be invalid.
